Employment Rights and Business Litigation

A trial lawyer since 1984, Sam Morgan has focused his practice on employment rights and business disputes since 1990. Mr. Morgan's practice is primarily litigation, but it also includes providing advice and counsel to both individual employees and employer-clients.

Mr. Morgan pursues and defends against employment-related lawsuits, such as breach of employment contract and wrongful discharge claims, age discrimination, sexual harassment, race discrimination, Family and Medical Leave Act, "Whistleblowers" and other unlawful retaliatory discharge claims, non-payment of wages, sales commissions and overtime pay, the enforcement of restrictive covenants such as non-competition agreements, confidentiality agreements, and disputes over the misappropriation, use and/or disclosure of proprietary information and/or trade secrets. The business disputes and lawsuits include minority owner oppression claims, breach of commercial contracts, and a variety of business torts.

These cases are litigated in state and federal courts, or in administrative agencies such as the Michigan Department of Civil Rights and the U.S. Equal Employment Opportunity Commission, or in private arbitration.

On the advice and counsel side, Mr. Morgan counsels and advises business owners and human resources professionals on workforce management issues, the development of personnel policies and procedures, discipline and termination decisions, and investigations of sexual harassment complaints and employee misconduct. He also assists both employee and employer clients with employment contracts, executive compensation agreements, and the negotiation of severance pay and separation agreements.

In the early years of his practice, Mr. Morgan gained much of his litigation and trial experience handling serious personal injury lawsuits resulting from automobile accidents.  With the change in Michigan's automobile negligence law, resulting from the Michigan Supreme Court's July 31, 2010 decision in McCormick v Carrier, Mr. Morgan has expanded his practice to again handle automobile negligence cases.

Mr. Morgan is AV-rated ("Preeminent") by Martindale-Hubbell (2005-2010), and is a Fellow of the Litigation Counsel of America. He is listed in "Best Lawyers in America" (2006-2010) for Labor and Employment Law, "Michigan SuperLawyers" (2006-2010) for his work in representing Plaintiffs in Employment Litigation, DBusiness' "Top Lawyers" (2006-2010) for Labor and Employment Law, Sexual Harassment and Wrongful Termination, and Crain's Detroit Business "Top Lawyers" (2009-2010) for Labor and Employment Litigation. He is a graduate of the University of Michigan in Ann Arbor, B.A., 1981, and Michigan State University College of Law, J.D., 1984.

A member of the State Bar of Michigan since 1984, Mr. Morgan is also admitted in the US District Court, E.Dist. Michigan, the US District Court, W. Dist. Michigan, and the US Sixth Circuit Court of Appeals. He is a member of the National Employment Lawyers Association (NELA), Detroit Metropolitan Bar Association, Macomb County Bar Association, the Novi Chamber of Commerce, the Greater Farmington Chamber of Commerce, and the Southern Wayne County Chamber of Commerce.
