On July 31, 2010, the Michigan Supreme Court decided McCormick v Carrier, which overruled a much-criticized 2004
Supreme Court decision that made it virtually impossible to get an automobile negligence lawsuit to trial. Under the
McCormick decision, the threshhold liability question of what constitutes a "serious impairment of body
function" will return to its pre-2004 level. The statute of limitations for an automobile negligence claim is 3
years. Therefore, if you were injured in an automobile accident during the past 3 years, even if you were previously
turned down by a lawyer, your claim may benefit dramatically from the McComick decision.
